However, a recent development in our community involving a Federal Bureau of Investigation (FBI) surveillance plane flying over West Baltimore has broadened our understanding of the variety of legal and ethical issues we encounter.
Intriguingly, the FBI has been utilizing a small Cessna airplane, registered to OTV Leasing, for surveillance activities. An investigation has linked this company back to the FBI, uncovering a practice where the FBI registers its surveillance aircraft to shell companies, many bearing the name Robert Lindley.
What particularly caught our attention was the revelation that the plane's transponder, which normally communicates its location to air traffic control, was off. Interestingly, a 2019 FAA rule allows government aircraft involved in "sensitive operations" to turn their transponders off, making this operation entirely lawful.
